TERMS AND CONDITIONS

1. These terms and conditions apply in all agreements made by Perfect Piece Organizing LLC (“LLC”).

2. Any person identified as a Provider of services by LLC is acting as a representative and/or employee of LLC, and not in an individual capacity.

3. Regarding disputes between Client and LLC, unless otherwise required by law:

a. Venue for any disputes with LLC shall be in Jefferson County, Texas.

b. Texas law shall apply.

c. Client waives the right to a trial by jury.

d. At LLC’s sole election, any dispute may be resolved by arbitration, in the location of proper venue. The arbitrator shall determine all issues, including whether a dispute is subject to arbitration.

e. As a prerequisite and as a condition precedent to a lawsuit filed by Client, Client must first request and participate in good faith in a mediation of a dispute to be conducted by the Jefferson County Dispute Resolution Center in Beaumont, Texas.

f. The prevailing party shall recover their reasonable and necessary attorney’s fees, including court costs and collection fees.

4. Client and LLC waive all claims against each other for incidental and consequential damages, including, but not limited to, lost profits and damages for loss of use of money.

5. LLC is not responsible for real or personal property owned and/or controlled by Client, that may be lost, damaged or disposed during the performance of the agreed services by LLC.

6. LLC is not responsible for recommending services, products or vendors used for organization or otherwise.

7. LLC is not responsible for performing construction services or the installation of any item or products. LLC’s agreed services are specifically listed in the agreement.
